Exclusive: Nearly 90% of children in federal custody being directed to GOP-controlled state that has unlicensed facilities and low legal representation rates
The Trump administration has started sending a majority of undocumented children who came to the US alone and have new immigration court cases to Texas, where government facilities for them are unlicensed<\/a>, their chances of getting a lawyer are low and advocates fear that \u201ca deportation churn-out factory\u201d awaits them, the Guardian has learned.
Almost 80% of children in federal custody who arrived unaccompanied by a parent or legal guardian and who were placed in immigration court proceedings in July \u2013 and over 90% in August \u2013 have been funneled into shelter networks somewhere in Texas<\/a>, a dramatic upswing from the months prior, according to analysis shared exclusively with the Guardian from researchers at the immigration data insights platform bklg.org.
This is understood to amount to<\/a> a total of 925 children in the care of the Health and Human Services (HHS) department\u2019s office of refugee resettlement (ORR) and in open immigration court proceedings based in Texas, with 651 sent there in July and August alone.
Federal officials\u2019 sudden shift toward ushering these vulnerable kids to the Republican-controlled, deeply conservative state for no publicly stated reason has alarmed immigrants\u2019 rights advocates amid concerns about their treatment and access to due process under US laws.
Experts who spoke to the Guardian fear the advent of a mass apprehension campaign \u2013 forcing immigrant children from their communities within the country\u2019s interior to gather them in Texas to ultimately pack them onto repatriation flights, which often leave from areas along the US\u2019s southern border.
\u201cWe\u2019re thinking about congregating children in facilities in Texas, where there are less attorneys, where it\u2019s one of the harshest jurisdictions, you know, in the country with regard to immigration judges and how they handle cases. And it\u2019s close to the border, where they can just get planes,\u201d said Roxana Avila-Cimpeanu, deputy director at the Arizona-based legal service non-profit, Florence Immigrant and Refugee Rights Project.
She added that these facilities could be \u201ca deportation churn out factory that has attorneys in name but not real representation\u201d.
Unaccompanied immigrant kids, who often come to the US fleeing abuse, neglect, abandonment, trafficking or other harms, regularly cross the US-Mexico border and enter the custody of ORR, which is legally tasked with their welfare, not the Department of Homeland Security\u2019s Immigration and Customs Enforcement (ICE<\/a>) agency.
There were more than 1,800 kids in ORR\u2019s care nationally at the end of July, scattered among shelters, foster care and secure facilities across the country. Yet already, more than 60% of those still detained with ongoing immigration court proceedings are now believed to be living in Texas, compared with fewer than half in June.
ORR did not respond to a request for comment from the Guardian.
The processing to Texas is occurring despite the state\u2019s GOP-dominated government refusing<\/a> to provide state licensing for ORR care providers, a policy that hasn\u2019t stopped the facilities from operating there, but has meant less child welfare oversight and protections for kids.
\u201cTexas is very sympathetic to the Trump administration<\/a>, at least the governor and the Republican legislature. And so I think the Trump administration knows that not only will there be no pushback from the state government and from the governor, but that people like Governor Greg Abbott are willing accomplices,\u201d Veronica Escobar, a Democratic congresswoman from west Texas, told the Guardian in a phone interview this week.
Meanwhile, many of the kids \u2013 from toddlers to teenagers \u2013 are navigating the US\u2019s byzantine immigration laws mostly without attorneys. Already, only 31.7% of children in ORR custody with active immigration court proceedings nationally have had a notice of legal representation filed in their cases. Kids held in Texas are faring even worse, with 17.2% in Houston, 18.6% in El Paso and just 8.7% in San Antonio having a legal representation form filed on their behalf, bklg.org\u2019s research found<\/a>.
\u201cThere needs to be far more oversight and representation, for children especially. These kids deserve lawyers,\u201d Escobar said.
At the same time, ORR officials have alarmed advocates by seeking multiple contracts for \u201cemergency influx facilities\u201d of up to 3,000 beds \u2013 despite the fact<\/a> that such facilities can only open when the agency\u2019s operational capacity reaches 85% or higher for multiple days, and ORR\u2019s shelter and foster care network, by its own count, is operating at about 27%<\/a> capacity.
\u201cWho are they planning to fill those facilities with?\u201d Avila-Cimpeanu asked. \u201cOur fear is huge mass internal apprehension of children.\u201d
Plans for such facilities were first reported by<\/a> the Independent last month.
At a recent roundtable presentation for roughly 120 stakeholders, ORR officials said the contracts would potentially give the administration \u201cthe capability to rapidly respond to any surges at the border of unaccompanied alien children\u201d, according to a transcript of the meeting shared with the Guardian.
But encounters with unaccompanied children at the south-west border have been exceptionally low<\/a> over the last year and a half. Still, officials pushed for an aggressive timeline, with only 90 days for a facility to become fully operational after a contract is awarded.
\u201cThat\u2019s fast and you\u2019re like: \u2018I don\u2019t know if I can do that.\u2019 I think it\u2019s very feasible. That is the intent of where we need to be,\u201d said Tony Canales, a branch chief at ORR\u2019s division of acquisition requirements, according to the transcript.
\u201cWe\u2019re looking to see whatever you got. I mean, if it\u2019s a permanent facility, if it\u2019s temporary buildings, if it\u2019s a site that is blank that you plan on building on, whatever the case may be. We will definitely look at it and take [it] into consideration,\u201d Canales told the attendees.
The presentation <\/strong>specified that any shelter would require an 8-ft high perimeter fence.
Although officials did not specify a location for such emergency influx facilities, many of the stakeholders closed in on Texas while asking questions.
Officials also said the chosen contractors would be responsible for providing legal services, which could present a serious conflict of interest given that attorneys tasked with representing kids would now be dependent on ORR.
For critics of the second Trump administration, the emergency influx facilities raise the spectre of a worst case scenario, with large-scale detentions for immigrant children in communities across the country, given that there is no apparent current need for the massive shelters otherwise.
\u201cThe way that a country and a government treats its children and children in their custody is a direct representation of the level of morality or immorality of that government and those individuals,\u201d Escobar said. \u201cAnd so it is shameful the way that this administration has chosen to treat children.\u201d
