The NBC10 Boston Investigators are uncovering new details about the lone holdout juror from the Lindsay Clancy<\/a> murder trial.
Court documents and interviews with family members reveal a history of domestic violence allegations<\/a>. We discovered a pending eviction case tied to months of not paying rent.
The NBC10 Boston Investigators also found an active restraining order against him, while he was listening to evidence in the case.
Those details raise questions about the jury selection process and how the Plymouth County resident was picked for the high-profile case that ended in a mistrial<\/a>.
NBC10 Boston has repeatedly attempted to contact the juror at home, where his landlord is currently trying to evict him.
We are not identifying him at this time because he has chosen not to speak publicly and the jury list is currently impounded. However, we wanted to share the details that experts say should have raised red flags about how he filled out his juror questionnaire.
In September of 2021, the holdout juror in the Clancy case faced a criminal charge for assaulting his wife out of Brockton District Court.
According to a police report, the juror\u2019s 13-year-old nephew called 911 after he said his uncle grabbed his wife by the throat and threw her into a dresser.
The report says the juror\u2019s mom repeatedly screamed, \u201cYou\u2019re evil!\u201d as police arrested him.
Court records show the couple divorced after the incident and the criminal charge was later dismissed.
The ex-wife told NBC10 Boston this week that she did not want to testify in the case because she was worried about losing custody of her daughter.
Last year, that same teenage nephew referenced in the 2021 incident took out a restraining order after he said the juror pushed him to the ground and repeatedly punched him in the face.
The teen wrote in his affidavit that his uncle then said, \u201cYou ruined my (expletive) life,\u201d for calling the police and added, \u201cYou\u2019ve had this coming your way for a long time.\u201d
That restraining order was still active when the juror was selected for the Clancy trial and listened to evidence for weeks in the controversial case.
\u201cI don\u2019t see how they would\u2019ve allowed him to be a member of this jury,\u201d NBC10 Boston\u2019s chief legal analyst Michael Coyne said.
The standard juror questionnaire in Massachusetts clearly asks if someone has been arrested, charged with a crime or been served with a court order. All of those boxes should have been checked by this juror.
\u201cI don\u2019t see how, if those questions had been answered correctly, one side or the other would\u2019ve taken the chance with allowing him to be seated,\u201d Coyne said.
The NBC10 Boston Investigators also learned that the holdout juror hasn\u2019t paid the monthly rent at his home since last March, according to housing court records.
As jurors deliberated last week, the landlord secured a judgment of more than $12,000 in unpaid rent and is moving forward with an eviction, housing court records show.
When the Clancy trial ended with no verdict, several jurors described how the lone holdout refused to engage in deliberations<\/a>, describing him as \u201carrogant\u201d and saying he wouldn\u2019t interact with them. One juror described the holdout juror\u2019s behavior as \u201cshocking.\u201d<\/a>
When the NBC10 Boston Investigators contacted the holdout juror\u2019s family members, they said he had been estranged since the incident with his nephew. None of them knew about his involvement with the Clancy trial.
One family member described him as a \u201cnarcissist\u201d who she believes never should have served as a juror in such an important case.
In the wake of these revelations, Coyne said he thinks the holdout juror\u2019s questionnaire will have to be reviewed by prosecutors to see if the information the juror put down was truthful.
\u201cIt is, in fact, a crime not to do so,\u201d he said.
NBC10 Boston has reached out to the Plymouth District Attorney\u2019s Office to ask about our findings, along with Clancy\u2019s defense team. Both sides declined to comment on Friday afternoon.
Juror questionnaires are not public records, so it\u2019s unclear if the document in question still exists or if it was destroyed in the wake of the mistrial. Because of that, NBC10 Boston cannot confirm how the juror filled out the questionnaire.
