That was powered \u2060by its conservative-leaning majority, overturning decisions by \u2060federal judges in New York and Washington \u200bDC that had halted the administration\u2019s actions terminating TPS for more than 350,000 people from Haiti and 6,100 from Syria.<br \/>The court\u2019s three liberal-leaning justices disagreed with the opinion. It leaves Haitians and Syrians in the US on TPS vulnerable to deportation even if they have applications for other forms of immigration status in progress.<br \/>The state department currently warns against traveling to either <a href=\"https:\/\/www.theguardian.com\/world\/haiti\" data-link-name=\"in body link\">Haiti<\/a> or <a href=\"https:\/\/www.theguardian.com\/world\/syria\" data-link-name=\"in body link\">Syria<\/a>, citing widespread violence, crime, terrorism and \u2060kidnapping.<br \/>All countries with a designation allowing TPS in the US are now considered under threat as the ruling will embolden the US president to strip other places of their status, no matter how risky it would be for immigrants to return there.<br \/>People with TPS are given permission to live and work in the US because the Department of Homeland Security (DHS) deems their home countries to be unsafe due to war, political instability or natural disasters. In the past year, Trump officials have attempted to cut the program for various countries, opening the door to the removal of hundreds of thousands of protected immigrants in the US.<br \/>During <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/apr\/29\/us-supreme-court-haitians-syrians-tps\" data-link-name=\"in body link\">arguments in late April<\/a>, the supreme court \u2013 controlled by a <a href=\"https:\/\/www.theguardian.com\/law\/2023\/jul\/01\/us-supreme-court-rulings-what-does-it-mean-affirmative-action-lgbtq-student-debt\" data-link-name=\"in body link\">supermajority of conservative justices<\/a> \u2013 appeared sympathetic to the administration\u2019s move to strip the protected status of Haitians and Syrians.<br \/>The US federal government argued the executive branch\u2019s decision to terminate TPS for Syria and <a href=\"https:\/\/www.theguardian.com\/world\/haiti\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Haiti<\/a> could not be reviewed by the judicial branch of the US government, due to the way the TPS legislation was originally written.<br \/>Attorneys who sued the administration last year, attempting to preserve TPS status for Haitians and Syrians, argued that DHS did not follow the proper process to terminate TPS. They also argued Haiti and Syria were not safe enough for people to return.<br \/>Last year, the supreme court allowed the Trump administration to <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/oct\/03\/us-supreme-court-venezuelans-tps\" data-link-name=\"in body link\">strip TPS from more than 300,000 Venezuelans<\/a> under the court\u2019s emergency docket.<br \/>The decision was highly anticipated, as analysts feared a decision in favor of the administration could open the door for it to terminate TPS for all countries in what would be the biggest de-documentation move in US history. Nearly 1.3m people were TPS holders in the US when <a href=\"https:\/\/www.theguardian.com\/us-news\/donaldtrump\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">Donald Trump<\/a> returned to office in January 2025.<br \/>The US first provided TPS to Haitians after a major earthquake in 2010 and to \u2060Syrians after their country descended into civil war in 2012.<br \/>On Thursday morning the conservative Justice Samuel Alito, who authored the ruling, wrote that courts cannot review the administration\u2019s decisions concerning TPS, a development that could doom legal challenges on revocation of this status for any country. The law governing TPS \u201cplainly bars\u201d such judicial \u200creview, Alito wrote.<br \/>He added that the Haitian TPS \u200cholders who sued the administration were unlikely to succeed in their argument that the administration\u2019s actions were racially biased and therefore violate the US constitution\u2019s fifth amendment promise of equal protection under the law.<br \/>Justice Elena Kagan wrote in a dissent joined by fellow liberal justices \u200bSonia Sotomayor and Ketanji Brown Jackson that the statute allows for judicial review of whether the DHS secretary \u201cadhered \u200cto the procedures it mandates \u2013 which is what the plaintiffs dispute \u200chere\u201d.<br \/>Kagan said evidence that race played a role in the Haiti decision \u201cis there, plain to see, in the president\u2019s statements, which the majority (and for that matter, his own lawyers) cannot even bear to repeat\u201d. Trump <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/apr\/29\/us-supreme-court-haitians-syrians-tps\" data-link-name=\"in body link\">has <\/a>called Haiti a \u201cshithole\u201d and a \u201chellhole\u201d of a country. While running \u200cfor re-election in 2024, he vowed to revoke TPS for Haitian immigrants in the US after he and his running mate, now vice-president JD Vance, made false and derogatory claims that <a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/sep\/14\/neo-nazis-springfield-ohio-haitian-immigrants\" data-link-name=\"in body link\">Haitians in Ohio<\/a> were eating <a href=\"https:\/\/www.theguardian.com\/us-news\/article\/2024\/sep\/09\/republicans-haitian-migrants-pets-wildlife-ohio\" data-link-name=\"in body link\">household pets<\/a> in Springfield.<br \/>Viles Dorsainvil, a Haitian TPS holder and co-founder of the Haitian Support Center in Springfield, said the ruling places thousands of families in immediate fear.<br \/>Sign up to <span>Breaking News US<\/span><br \/>Get the most important news as it breaks<br \/>after newsletter promotion<br \/>\u201cHaiti is not safe, and everyone knows it. The court\u2019s ruling does not change the reality on the ground or the contributions we make here in the United States,\u201d Dorsainvil said.<br \/>Lawyers for the Haitian immigrants, Geoff Pipoly and Andy Tauber, said in a statement that \u201cimmigrants are one of America\u2019s greatest strengths. \u200cThe responsibility to save these lives is now with Congress.\u201d<br \/>Ahilan Arulanantham, a lawyer for the Syrian plaintiffs in the case, was appalled.<br \/>\u201cToday the supreme court allowed the government to ignore a bedrock humanitarian protection that Congress, in bipartisan fashion, established three decades ago to ensure that vulnerable refugees would not be subject to partisan whims,\u201d he said.<br \/>The court backed Trump \u200cin a second <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jun\/25\/supreme-court-ruling-asylum-seekers-us-mexico-border\" data-link-name=\"in body link\">immigration-related decision<\/a> on Thursday, also written by Alito and also decided 6-3 with the liberals dissenting. It also sided with the Trump administration, supporting its defense of the government\u2019s authority to turn away asylum seekers when officials deem <a href=\"https:\/\/www.theguardian.com\/us-news\/us-mexico-border\" data-link-name=\"in body link\">US-Mexico border<\/a> crossings too overburdened to handle additional claims. The administration has said it may seek to revive the policy, known as metering, after it was dropped by Trump\u2019s predecessor, Joe Biden.<br \/>The legal fight over TPS presented another test of Trump\u2019s executive power and the supreme court\u2019s \u200bdeference to presidents on matters of immigration, national security and foreign policy. Trump has been intent on rolling back immigration since returning to office in January 2025.
