(Jury selection was previously set to start on Sept. 8, with opening statements scheduled for Oct. 13.)<br \/>Hours later, New York Judge Gregory Carro pushed the start of Mangione\u2019s state trial from June 8 to Sept. 8.<br \/>Mangione\u2019s lawyers had asked Garnett to postpone the federal proceedings until January. The defense argued that the overlap between the two proceedings would make it difficult for Mangione to prepare for the federal case. The new timetable could lead to even closer overlap between the two trials.<br \/>The Manhattan district attorney\u2019s office declined to comment. The U.S. attorney\u2019s office and Mangione\u2019s legal team did not immediately respond to requests for comment.<br \/>Garnett said the more modest delay of a few weeks would ensure Mangione\u2019s right to a fair trial. She expressed particular concern about the prospect of potential jurors in the federal trial filling out questionnaires while the state case was unfolding in a courthouse just \u201ctwo blocks away.\u201d<br \/>\u201cWhether we like it or not, we are at the will of the state case,\u201d Garnett said, adding that it\u2019s \u201cinevitable\u201d and \u201cit\u2019s the nature of dual prosecutions.\u201d<br \/>Mangione has <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/luigi-mangione-pleads-not-guilty-federal-murder-stalking-charges-rcna202974\" target=\"_blank\">pleaded not guilty<\/a> in both proceedings. He leaned forward and rested his chin on his right hand as Garnett addressed the federal courtroom on Wednesday.<br \/>Thompson was shot and killed outside the New York Hilton Midtown hotel on the morning of Dec. 4, 2024, as he was on his way to an investors conference. Five days later, amid a frantic manhunt, Mangione was arrested at a McDonald\u2019s in Altoona, Pennsylvania.<br \/>In the federal case, Mangione faces two counts of stalking, which carry a maximum sentence of life in prison without the possibility of parole. <br \/>Prosecutors originally charged him with two other offenses \u2014 murder through use of a firearm, which carried a potential death sentence, and a related firearms count \u2014 but Garnett dismissed those charges in late January.<br \/>Garnett ruled that the murder charge can only be used in tandem with a \u201ccrime of violence.\u201d She found that Mangione\u2019s alleged stalking of Thompson did not meet that standard, effectively blocking prosecutors from seeking the death penalty.<br \/>In the state case, Mangione faces nine felony charges, including second-degree murder and various counts related to criminal possession of a weapon.<br \/>New York state prosecutors initially attempted to prosecute Mangione on two other charges \u2014 first-degree murder \u201cin furtherance of terrorism\u201d and second-degree murder \u201cas an act of terrorism\u201d \u2014 but <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/new-york-judge-dismisses-state-terrorism-charges-luigi-mangione-keeps-rcna231594\" target=\"_blank\">a judge tossed those counts last year<\/a>, ruling they were \u201clegally insufficient.\u201d<br \/>The state charges carry the possibility of life in prison.
