Trump said Rodr\u00edguez had talked to Secretary of State Marco Rubio and was &#8220;essentially willing to do what we think is necessary to make Venezuela great again.&#8221;<br \/>However, Rodr\u00edguez\u00a0<a href=\"https:\/\/thehill.com\/policy\/international\/5670877-venezuela-delcy-rodriguez-nicolas-maduro-capture-trump-us\/\" target=\"_blank\" rel=\"noopener noreferrer\">criticized<\/a>\u00a0the U.S. military action as &#8220;brutal aggression&#8221; on state television and called for Maduro&#8217;s immediate release.<br \/>Maduro, an authoritarian, has led Venezuela since 2013, succeeding an ideological ally, Hugo Ch\u00e1vez, who had been in office since 1999. Under both men, U.S. relations with Venezuela frayed over foreign policy, oil and human rights.<br \/>In July 2024, Maduro declared victory following an election that international observers described as fraudulent. Please check your inbox to confirm.<br \/>When a reporter asked Trump during the Mar-a-Lago press event whether he&#8217;d spoken to Venezuelan opposition leader Maria Corina Machado following Maduro&#8217;s arrest, Trump said Machado &#8220;doesn&#8217;t have the support or the respect within the country.&#8221;<br \/>Machado, who recently\u00a0<a href=\"https:\/\/www.nobelprize.org\/prizes\/peace\/2025\/machado\/facts\/\" target=\"_blank\" rel=\"noopener noreferrer\">won<\/a>\u00a0the Nobel Peace Prize for her fight for democracy in Venezuela, had a 72% approval rating from Venezuelans according to a March\u00a0<a href=\"https:\/\/www.infobae.com\/venezuela\/2025\/03\/27\/el-64-de-los-venezolanos-considera-ilegitimo-el-mandato-de-nicolas-maduro\/\" target=\"_blank\" rel=\"noopener noreferrer\">poll<\/a>\u00a0by ClearPath Strategies.<br \/>Trump said without evidence that the United States&#8217; role in governing Venezuela &#8220;won&#8217;t cost us anything&#8221; because U.S. oil companies would invest in new infrastructure in the oil-rich country. &#8220;It&#8217;s going to make a lot of money,&#8221; Trump said.<br \/>Here, we fact-checked Trump&#8217;s and Rubio&#8217;s statements from the press conference.<br \/>The administration&#8217;s lack of warning to Congress bucks laws and precedents.<br \/>Rubio\u00a0<a href=\"https:\/\/www.c-span.org\/program\/white-house-event\/pres-trump-holds-news-conference-on-us-airstrikes-against-venezuela\/671134\" target=\"_blank\" rel=\"noopener noreferrer\">said<\/a>\u00a0members of Congress were not notified in advance. Trump said the administration was concerned about Congress potentially leaking news of the administration&#8217;s decision to capture Maduro.<br \/>Senate Majority Leader John Thune, R-S.D.,\u00a0<a href=\"https:\/\/x.com\/LeaderJohnThune\/status\/2007464869432267134\" target=\"_blank\" rel=\"noopener noreferrer\">praised<\/a>\u00a0the operation as a &#8220;decisive action.&#8221;<br \/>But Congressional Democrats said Congress should have been notified in advance. Sen. Tim Kaine, D-Va.,\u00a0<a href=\"https:\/\/x.com\/timkaine\/status\/2007506820517253431\" target=\"_blank\" rel=\"noopener noreferrer\">said<\/a>, &#8220;Maduro is terrible. But Trump put American servicemembers at risk with this unauthorized attack.&#8221;<br \/><a href=\"https:\/\/www.pbs.org\/newshour\/politics\/maduros-capture-and-trumps-claim-that-u-s-will-run-venezuela-raise-new-legal-questions\"><strong>READ MORE:<\/strong> Maduro&#8217;s capture and Trump&#8217;s claim that U.S. will run Venezuela raise new legal questions<\/a><br \/>Sen. Jeanne Shaheen, D-N.H.,\u00a0<a href=\"https:\/\/www.nytimes.com\/live\/2026\/01\/03\/world\/trump-united-states-strikes-venezuela\/a38e3f09-8a7b-5101-a16d-82bce7f92ff6?smid=url-share\" target=\"_blank\" rel=\"noopener noreferrer\">said<\/a>\u00a0Trump and his cabinet were not forthcoming about their intentions for regime change, so &#8220;we are left with no understanding of how the administration is preparing to mitigate risks to the U.S. and we have no information regarding a long-term strategy following today&#8217;s extraordinary escalation.&#8221;<br \/>The U.S. Constitution assigns Congress the right to declare war. The last time that happened was for World War II.<br \/>Since then, presidents have\u00a0<a href=\"https:\/\/www.politifact.com\/article\/2025\/jun\/22\/did-trump-violate-war-powers-act-by-bombing-iran\/\">generally initiated<\/a>\u00a0military action using their constitutionally granted powers as commander in chief without an official declaration of war.<br \/>Since Congress passed the 1973\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/93rd-congress\/house-joint-resolution\/542\/text\" target=\"_blank\" rel=\"noopener noreferrer\">War Powers Resolution<\/a>, the president has had to report to Congress within 48 hours of introducing the U.S. military into hostilities and terminate the use of the military within 60 days unless Congress approves. If approval is not granted and the president deems it an emergency, an additional 30 days are granted for ending operations.<br \/>In recent decades, congressional consent has usually been granted through an authorization for the use of military force. But an authorization has not been passed for operations in Venezuela. Kaine and other lawmakers have pursued\u00a0<a href=\"https:\/\/www.kaine.senate.gov\/press-releases\/kaine-merkley-introduce-bill-to-prohibit-federal-funds-to-pay-for-war-against-venezuela\" target=\"_blank\" rel=\"noopener noreferrer\">legislation<\/a>\u00a0\u2014 so far fruitlessly \u2014\u00a0 to prohibit the use of federal funds for any use of military force in or against Venezuela without Congressional authorization.<br \/>The Trump administration has whittled away at prior notification requirements. Under\u00a0<a href=\"https:\/\/sgp.fas.org\/crs\/intel\/R40698.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">federal law<\/a>, eight bipartisan, senior members of Congress must receive prior notice of particularly sensitive covert actions. In June 2025, the administration\u00a0<a href=\"https:\/\/www.politifact.com\/article\/2025\/jun\/22\/did-trump-violate-war-powers-act-by-bombing-iran\/\">told Republicans, but not Democrats<\/a>, about the forthcoming U.S. strike on Iranian nuclear facilities. For the Venezuela operation, it appears no lawmakers were notified in advance.<br \/><a href=\"https:\/\/www.pbs.org\/newshour\/politics\/fact-checking-trumps-claim-that-each-boat-strike-off-venezuelas-coast-saves-25000-lives\">Pants on Fire!<\/a><br \/>The Trump administration has\u00a0<a href=\"https:\/\/www.wola.org\/2025\/11\/us-military-strikes-trump-drugs-caribbean\/\" target=\"_blank\" rel=\"noopener noreferrer\">struck<\/a>\u00a0at least 32 vessels killing about 115 people in the Caribbean Sea and Eastern Pacific Ocean since September. Trump said previously that the boats were carrying drugs en route to the U.S. and during the press conference he said the drugs on each boat would kill &#8220;on average, 25,000 people.&#8221;<br \/>However, experts on drugs and Venezuela told\u00a0<a href=\"https:\/\/www.politifact.com\/article\/2025\/sep\/22\/Trump-Venezuela-boat-strikes-drugs-trafficking\/\">PolitiFact<\/a>\u00a0the country plays a minor role in trafficking drugs that reach the U.S. And the administration has provided\u00a0<a href=\"https:\/\/www.pbs.org\/newshour\/world\/a-timeline-of-u-s-military-escalation-against-venezuela-leading-to-maduros-capture\" target=\"_blank\" rel=\"noopener noreferrer\">no evidence<\/a>\u00a0about the type or quantity of drugs it says were on the boats. This lack of information makes it impossible to know how many lethal doses of the drugs could have been destroyed.<br \/>The Centers for Disease Control and Prevention\u00a0<a href=\"https:\/\/www.cdc.gov\/nchs\/nvss\/vsrr\/drug-overdose-data.htm\" target=\"_blank\" rel=\"noopener noreferrer\">reported<\/a>\u00a073,000 U.S. drug overdose deaths from May 2024 to April 2025. That means the drugs on 32 boats would have been responsible for 800,000 deaths, nearly 11 times the number of U.S. overdose deaths in one year.<br \/>There is\u00a0<a href=\"https:\/\/www.politifact.com\/factchecks\/2024\/apr\/10\/donald-trump\/donald-trump-exaggerates-venezuelan-crime-drop-and\/\">no evidence<\/a>\u00a0Maduro sent members of Venezuelan prison\u00a0<a href=\"https:\/\/www.politifact.com\/article\/2024\/nov\/01\/tren-de-aragua-what-we-know-about-the-venezuelan-g\/\">gang<\/a>\u00a0Tren de Aragua to the U.S.<br \/>The U.S. Justice Department\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/media\/1422326\/dl\" target=\"_blank\" rel=\"noopener noreferrer\">indictment<\/a>\u00a0against Maduro does not mention Trump&#8217;s statement.<br \/>An April\u00a0<a href=\"https:\/\/static01.nyt.com\/newsgraphics\/documenttools\/32f71f10c36cc482\/d90251d5-full.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">report<\/a>\u00a0from the federal National Intelligence Council\u00a0<a href=\"https:\/\/www.nytimes.com\/2025\/03\/20\/us\/politics\/intelligence-trump-venezuelan-gang-alien-enemies.html\" target=\"_blank\" rel=\"noopener noreferrer\">contradicted<\/a>\u00a0Trump&#8217;s statements about links between Maduro and Tren de Aragua.<br \/>&#8220;While Venezuela&#8217;s permissive environment enables (Tren de Aragua) to operate, the Maduro regime probably does not have a policy of cooperating with TDA and is not directing TDA movement to and operations in the United States,&#8221; the report said.<br \/>This\u00a0<a href=\"https:\/\/www.washingtonpost.com\/world\/2025\/12\/20\/venezuela-oil-nationalization-expropriation\/\" target=\"_blank\" rel=\"noopener noreferrer\">needs context<\/a>.<br \/>In the early 20th century, Venezuela&#8217;s long-serving dictator, Juan Vicente G\u00f3mez, allowed foreign companies almost exclusive access to the country&#8217;s oil resources.<br \/>In 1975, after decades of seeking greater control of its oil resources, Venezuela nationalized its oil industry.<br \/>&#8220;Trump&#8217;s claim that Venezuela has stolen oil and land from the U.S. is baseless,&#8221; Francisco Rodr\u00edguez, a Venezuelan economist at the University of Denver,\u00a0<a href=\"https:\/\/www.washingtonpost.com\/world\/2025\/12\/20\/venezuela-oil-nationalization-expropriation\/\" target=\"_blank\" rel=\"noopener noreferrer\">told the Washington Post<\/a>. &#8220;The U.S. was much more interested in having Venezuela be a provider of oil \u2014 relatively cheap oil \u2014 than to have a production collapse in Venezuela,&#8221; Rodr\u00edguez said. As a result, the change was &#8220;relatively uncontroversial&#8221; at the time.<br \/>U.S. oil companies, including Exxon and Mobil and Gulf, now Chevron, lost about $5 billion each in assets and were compensated $1 billion each, according to\u00a0<a href=\"https:\/\/www.nytimes.com\/1977\/01\/29\/archives\/oil-nationalization-in-venezuela-quiet-companies-taken-over.html\" target=\"_blank\" rel=\"noopener noreferrer\">news reports<\/a>, the Post reported.<br \/><a href=\"https:\/\/www.pbs.org\/newshour\/politics\/watch-we-want-it-back-trump-demands-venezuela-return-land-oil-rights-to-u-s\"><strong>WATCH:<\/strong> &#8216;We want it back&#8217;: Trump demands Venezuela return &#8216;land, oil rights&#8217; to U.S.<\/a><br \/>But Rodr\u00edguez said the companies didn&#8217;t push for additional compensation at the time, in part because no forum existed to do so.<br \/>In general, experts\u00a0<a href=\"https:\/\/www.politifact.com\/article\/2016\/sep\/09\/should-US-have-kept-Iraq-oil\/\">have told PolitiFact<\/a>\u00a0that invading a country to take its oil would be both illegal and unethical. In 2016, Trump mused about how the U.S. should have taken Iraq&#8217;s oil when it invaded to oust Saddam Hussein.<br \/>Experts pointed to the\u00a0<a href=\"http:\/\/avalon.law.yale.edu\/20th_century\/hague04.asp\" target=\"_blank\" rel=\"noopener noreferrer\">Annex to the Hague Convention of 1907 on the Laws and Customs of War<\/a>, which says that &#8220;private property &#8230; must be respected (and) cannot be confiscated.&#8221; It also says that &#8220;pillage is formally forbidden.&#8221;<br \/>&#8220;If &#8216;to the victors go the spoils&#8217; was legal doctrine, then we would have believed that (then-Iraqi leader Saddam Hussein) should have been able to keep Kuwait City after he invaded&#8221; in 1990, terrorism analyst Daveed Gartenstein-Ross told PolitiFact in 2016. &#8220;But we viewed that \u2014 quite rightly \u2014 as an act of aggression under the U.N.
