The judge rejected that argument.<br \/>Carro pointed to a supreme court decision stipulating that state and federal government are \u201ctwo sovereigns\u201d, and \u201cwhere there are two sovereigns, there are two laws, and two offenses\u201d.<br \/>\u201cThus, there is no double jeopardy violation,\u201d he wrote.<br \/>Carro also rejected the defense\u2019s bid to put Mangione\u2019s state case on hold so he can face his federal trial first. Mangione\u2019s team has argued that testifying in the state case could harm his defense in the federal death penalty trial, and claimed the timing could violate his right against self-incrimination<strong>.<\/strong><br \/>In response to Carro\u2019s ruling, a spokesperson for the Manhattan district attorney\u2019s office commented: \u201cWe respect the Court\u2019s decision and will proceed on the remaining nine counts, including Murder in the Second Degree.\u201d<br \/>The sentence for second-degree murder in <a href=\"https:\/\/www.theguardian.com\/us-news\/new-york\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">New York<\/a> ranges from 25 years to life imprisonment. Mangione is scheduled to return to state court on 1 December.<br \/>Mangione entered the Manhattan courtroom just before 9.30am, wearing khaki jail scrubs, with handcuffed wrists and shackled ankles. His appearance came six days after the rightwing commentator <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/sep\/11\/charlie-kirk-shooting-maps-videos-images\" data-link-name=\"in body link\">Charlie Kirk<\/a> was shot dead during an event at Utah Valley University. The shootings of Thompson and Kirk have prompted highly politicized rhetoric.<br \/>Although a motive in Kirk\u2019s shooting remains unknown, conservatives have used the incident to call for the investigation of progressive political groups. <a href=\"https:\/\/www.theguardian.com\/us-news\/donaldtrump\" data-link-name=\"in body link\">Donald Trump<\/a> has demanded the death penalty against the suspected Kirk shooter, Tyler Robinson, and his justice department is seeking the death penalty for Mangione.<br \/>The US attorney general, Pam Bondi, called Thompson\u2019s killing \u201ca premeditated, cold-blooded assassination that shocked America\u201d. Bondi said her decision was in step with \u201cTrump\u2019s agenda to stop violent crime and make America safe again\u201d.<br \/>The killing sparked a contentious public debate about <a href=\"https:\/\/www.theguardian.com\/us-news\/healthcare\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\">US healthcare<\/a> that crossed the political aisle, with some praising Mangione and denouncing healthcare companies and many others outraged that a murder would be used to air political grievances.<br \/>On Tuesday outside the 100 Centre Street courtroom, as with his prior court appearances, Mangione supporters gathered for a glimpse of him, lining up for courtroom seats and fanning themselves with yellow index cards that guaranteed entry. One woman wore a black T-shirt emblazoned with \u201cFREE LUIGI\u201d and another a white one reading \u201cLUIGI\u2019S PIZZA\u201d.<br \/>Another woman, who like others appeared to be in her 20s, wore a deep green leopard frock, with coordinating socks and ankle-strap platform heels. Some attendees had on medical masks.<br \/>When lead defense attorney Karen Agnifilo entered the 13th floor hallway where this proceeding was held, some of Mangione\u2019s fans craned their necks to get a better look.
