Richard Glossip<\/a>, who spent nearly 30 years on death row before the Supreme Court overturned his conviction this year, will remain in custody while he awaits a new trial.
Oklahoma County District Judge Heather Coyle denied bond for Glossip on Wednesday, concluding the state had shown that “the presumption of the defendant\u2019s guilt of a capital offense is great.\u201d
Glossip, a former motel manager, was convicted in 1997 of commissioning the murder of his former boss Barry Van Treese, the owner of a motel in Oklahoma City. Glossip has maintained his innocence.
The Supreme Court threw out<\/a> Glossip\u2019s murder conviction in February because a key witness lied in court and prosecutors withheld information about him.
The witness, Justin Sneed, admitted killing Van Treese but told prosecutors that the killing was at Glossip’s direction in exchange for $10,000. Sneed, a motel handyman, was sentenced to life for the crime, while Glossip received the death penalty.
In the Supreme Court’s majority ruling, Justice Sonia Sotomayor wrote that prosecutors “knew Sneed\u2019s statements were false” and that \u201cbecause Sneed\u2019s testimony was the only direct evidence of Glossip’s guilt of capital murder, the jury\u2019s assessment of Sneed’s credibility was necessarily determinative here.”
“Hence, there is a reasonable likelihood that correcting Sneed\u2019s testimony would have affected the judgment of the jury,” she wrote.
Since the ruling, Glossip has been removed from death row and held without bail in the Oklahoma County Detention Center.
The high court\u2019s ruling came several years after a group of bipartisan Oklahoma lawmakers championed Glossip\u2019s innocence, commissioning an independent report in his defense<\/a>.
The 2022 report <\/a>concluded that \u201cno reasonable jury hearing the complete record would convict Glossip of first-degree murder.\u201d
Last month, Oklahoma Attorney General Gentner Drummond said he intends to pursue a new murder trial<\/a> against Glossip on a first-degree murder charge.
“While it was clear to me and to the U.S. Supreme Court that Mr. Glossip did not receive a fair trial, I have never proclaimed his innocence,” Drummond said in a statement at the time. “After the high court remanded the matter back to district court, my office thoroughly reviewed the merits of the case against Richard Glossip and concluded that sufficient evidence exists to secure a murder conviction.”
Drummond on Thursday praised the ruling against bond.
\u201cI am committed to ensuring the defendant\u2019s constitutional right to a fair trial and finally delivering true justice to the Van Treese Family after so many long years,\u201d he said in a statement.
